Status Update Available March 30 For Processing Of Employment-Based Green Cards Under New USCIS Policy On Pending FBI Name Checks

USCIS has moved up the date to March 30, 2008 for seeking status updates on employment-based green card cases that may be eligible for processing in light of the change in policy regarding pending FBI name checks, according to AILA.

Previously, USCIS had said it would need until April 30, 2008 to sweep its files and identify cases subject to processing in light of the new policy. AILA is reporting now, however, that USCIS service centers say they will accept requests on status updates for employment-based cases effective March 30, 2008.

    Thank you for the update. The Q&A document was removed from USCIS website shortly after publishing it. According to AILA [ ] , it is being revised and will be reposted within few days.

    Do you have any update on what’s going on in regards to that?

    The Q&A document promised to “process” all cases eligible pursuant to the new memo by Mid-March. Will there be a change in that date?

    How can one find out if their case was picked up these “sweeps”?

    Your expert opinion will be highly appreciated and thanks again for great coverage.

    Thank you for visiting our site. We do not have any updated Q & A yet, but as soon as it is available we will post it.

    One point of clarification regarding your comment as to the availability of status updates following the USCIS sweeps: The USCIS revised availabilty for a status update of March 30 is only for employment-based green card applications. This statement presumably means all other applications remain subject to the original date, which USCIS identified as April 30, 2008.

    Whether your case was picked up by these sweeps is available for checking after these status availability dates specified by USCIS.

    In other words, if your green card application is based on employment, you can check after March 30. For any others, you can check with USCIS after April 30.

    Of course, this information is subject to change, pending any USCIS announcements. Stay tuned!
